Purpose and Reason:

The department is filing these Rules pursuant to RIGL 42-35-3(b) as emergency regulations to protect the health and safety of Rhode Islanders in crisis seeking acute behavioral health treatment. The promulgation of these rules will expedite access to mental health services and ensure that individuals with mental illness receive behavioral health treatment in less restrictive clinically appropriate settings that are commensurate with the health and safety of the individual and others. The main purpose of this amendment is to create The Behavioral Health Acute Stabilization unit as a hospital diversion and step down unit for Rhode Island residents 18 years of age or older who are experiencing a psychiatric and/or substance abuse related crisis. This unit will provide ongoing assessment and observation, crisis intervention and psychiatric, substance and Co-occurring treatment. In addition, revisions have been made to Section 30.0 Medication and Laboratory Services, and Section 44.0 Opioid Treatment Programs.

This filing is a technical revision of 120-day emergency amendment ERLID 5807. The only change to this filing was the cover sheet indicated “June 2009 (Proposed)” under the “As Amended” portion, the “(Proposed)” was deleted because it was left on in error. The effective and termination dates are not changed from ERLID 5807.
